1. Introduction #

Welcome to XAR Hub. These Terms of Service ("Terms") govern your access to and use of the XAR Hub platform, website and related services. By creating an account, accessing or using XAR Hub, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use the platform.

2. Definitions #

For the purposes of these Terms: Platform means the XAR Hub website, dashboard, applications and services. User means any person or organization using XAR Hub. Account means a registered user profile. Project means a digital business profile created within XAR Hub. Content means any information uploaded by a user including text, images, files, logos, menus and business information.

3. Eligibility #

You must have legal capacity under the laws of your country to use the platform. If you use XAR Hub on behalf of a company or organization, you confirm that you have authority to bind that organization to these Terms.

4. User Accounts #

Users are responsible for:

Maintaining accurate account information.
Keeping login credentials confidential.
All activity performed through their account.
Promptly notifying XAR Hub of unauthorized access.

Users may not share accounts unless explicitly permitted.

5. Platform Usage #

Users may use XAR Hub only for lawful purposes. You agree not to:

Violate applicable laws.
Upload illegal content.
Attempt unauthorized access.
Interfere with platform security.
Distribute malware.
Abuse platform resources.
Reverse engineer the platform except where permitted by law.

6. User Content #

Users retain ownership of all content uploaded to XAR Hub. By uploading content, you grant XAR Hub a limited, non-exclusive, worldwide license to host, process, display and transmit that content solely for the purpose of operating the platform. This license ends when the content is deleted, except where retention is required by law.

7. Intellectual Property #

All intellectual property related to XAR Hub, including:

Software
Source code
User interface
Branding
Logos
Documentation
Design assets

remains the exclusive property of XAR Hub or its licensors. Nothing in these Terms transfers ownership of XAR Hub intellectual property.

8. Subscription Services #

XAR Hub may provide:

Free plans
Paid subscriptions
Premium modules
Enterprise services
Hardware products

Pricing is published separately and may change from time to time.

9. Payments #

Where paid services are offered:

Payments are due according to the selected plan.
Taxes may apply depending on jurisdiction.
Payment processing is performed by authorized third-party providers.

Failure to pay may result in suspension or termination of access to paid services.

10. Availability #

XAR Hub aims to provide reliable service but does not guarantee uninterrupted availability. The platform may occasionally experience:

Maintenance
Updates
Security improvements
Temporary outages

Reasonable efforts will be made to minimize disruptions.

11. Third-Party Services #

The platform may integrate with third-party providers. XAR Hub is not responsible for the availability, content or policies of external services. Use of third-party services may be subject to separate agreements.

12. Privacy #

The processing of personal information is governed by the XAR Hub Privacy Policy. By using the platform, users acknowledge that personal information will be processed in accordance with that policy.

13. Suspension #

XAR Hub may suspend or restrict accounts where necessary to:

Protect platform security.
Prevent abuse.
Investigate fraud.
Comply with legal obligations.
Enforce these Terms.

Suspension may occur without prior notice where immediate action is necessary.

14. Termination #

Users may close their account at any time. XAR Hub may terminate accounts that:

Violate these Terms.
Engage in unlawful activities.
Threaten platform security.
Repeatedly abuse the service.

Termination does not remove obligations that arose before termination.

15. Limitation of Liability #

To the maximum extent permitted by law: XAR Hub shall not be liable for indirect, incidental, consequential or special damages arising from the use of the platform. Total liability shall not exceed the amount paid by the user to XAR Hub during the twelve months preceding the claim. Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

16. Indemnification #

Users agree to indemnify and hold harmless XAR Hub from claims, damages and expenses arising from:

Violation of these Terms.
Illegal use of the platform.
Infringement of third-party rights.
Uploaded content.

17. Changes to the Service #

XAR Hub may modify, improve or discontinue features at any time. Where changes materially affect users, reasonable notice will be provided when appropriate.

18. Changes to these Terms #

These Terms may be updated periodically. The latest version will always be published on the XAR Hub website. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.

19. Governing Law #

These Terms shall be governed by the laws applicable to the legal entity operating XAR Hub, except where mandatory consumer protection laws require otherwise.

20. Dispute Resolution #

The parties agree to attempt to resolve disputes through good-faith negotiations before initiating legal proceedings where applicable. Nothing in this section limits statutory rights available under applicable law.

21. Severability #

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement #

These Terms, together with the Privacy Policy and other legal documents published by XAR Hub, constitute the entire agreement between the user and XAR Hub regarding use of the platform.
